ORDINANCE NO 5 OF 1964

AN ORDINANCE ADOPTING A BUILDING CODE FOR THE CITY OF EMMET, ARKANSAS REGULATING THE ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING, REMOVAL, CONVERSION, DEMOLITION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA, AND MAINTENANCE OF BUILDINGS OR STRUCTURES IN THE CITY OF EMMET, ARKANSAS; PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFOR; PROVIDING PENALTIES FOR THE VIOLATION THEREOF; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH AND DECLARING AN EMERGENCY. 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EMMET, ARKANSAS:

Section 1) That the Southern Standard Building Code (1960-61 Revision) and the whole thereof, of which code not less than three (3) copies have been and are now filed in the Office of the Recorder of the City of Emmet, Arkansas, be and the same are hereby adopted and incorporated in this Ordinance as fully as if set out word for word herein, and from the date on which this Ordinance shall take effect, the provisions thereof shall be controlling and binding within the corporate limits of the City of Emmet, Arkansas. 

Section 2) The City Recorder of the City of Emmet, Arkansas is hereby authorized, directed, and empowered to insert therein at an appropriate place in each copy of said code, a certificate to the effect that said Code is an official publication of the buildings laws, Ordinances and resolutions passed and adopted by the City Council of the City of Emmet, Arkansas, and that said publication in book form of said building ordinances, laws and resolutions affecting the City of Emmet, Arkansas by authority and under the direction of the Mayor and City Council of the City of Emmet, Arkansas is effective as the building laws and ordinances of said City.

Section 3) All laws, ordinances, and parts of ordinances in conflict herewith are hereby repealed. 

Section 4) The City Council hereby declares that should any, word, sentence, paragraph, section, or part of this Ordinance or the Code hereby adopted be declared for any reason to be invalid, such invalidity shall not render the remaining portions thereof invalid, as the City Council intends that it would have passed all other portions of this Ordinance independent of the elimination therefrom of any portion of this Ordinance or the Code hereby adopted which may be declared invalid.

Section 5) That the City Council does hereby find that there is an immediate need for a code of minimum standards for the construction of buildings within the limits of the City of Emmet, Arkansas, and this Ordinance thus being necessary for the preservation of the peace, health, safety, and welfare of the inhabitants of the City of Emmet, Arkansas, an emergency is hereby declared to exist, and this Ordinance shall be in full force and effect, from and after its passage and approval.
