 Live Stock Ordinance  CITY OF EMMET ORDINANCE NO 3OF 1994 AN ORDINANCE TO PROHIBIT LIVESTOCK IN THE CITY LIMITS OF THE CITY OF EMMET; PROVIDING A PENALTY, THEREFORE, AND FOR OTHER PURPOSES.NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL FOR THE CITY OF EMMET, ARKANSAS, THAT: SECTION 1 PROHIBITION OF LIVESTOCK Any person, firm, or the corporation is prohibited from owning, possessing, or storing for the benefit of another party any livestock within the legally-recognized corporate limits of the City of Emmet, Arkansas, unless such livestock is situated on the property having a minimum area of two acres, regardless of shape, which minimum two-acre area shall be closed within a fence and shall all be contiguous.SECTION 2  PENALTY Any person, firm, or corporation who shall violate the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof, shall be fined in the sum not less than $50.00 no more than $100.00, and each day which such prohibited conduct continues shall constitute a separate and distinct violation for penalty purposes. SECTION 3 DEFINITIONS For purposes of interpreting and enforcing this ordinance, the term “livestock” shall include horses, cows, bulls, sheep, goats, chickens, and rabbits; the term“fence” shall mean a five-strand barbed wire fence with wooden or metal posts properly maintained in a sufficient condition and at sufficient intervals, and height to prohibit the escape of livestock from the enclosed premises where said livestock are situated, and the term “residence” shall include any building regardless of size, condition, or material which is constructed to serve or may serve as a dwelling place for one or more individuals. SECTION 4  SEPARABILITY Any portion of this Ordinance that may be determined to be invalid or unenforceable shall not affect the enforceability or validity of any other portions of this ordinance. SECTION 5 REPEALER All Ordinances or parts of Ordinances in conflict herewith are hereby expressly repealed.SECTION 6 EMERGENCY the Citizens of the City of Emmet, Arkansas has determined that permitting livestock to raise and run at large in the City limits of Emmet, Arkansas constitutes and creates unsanitary and unhealthy conditions for the inhabitants of the City, and this Ordinance being necessary for the immediate preservation of the public peace, health, safety, and welfare of the City of Emmet, Arkansas, an emergency is hereby declared to exist and this Ordinance shall be in full force and effect from and after its passage and approval.
